Speedy trial and effective punishment

Rape cases are increasing in the country. Although various steps have been taken at various times to prevent the recurrence of such incidents, including amending the law, they have not met with expected success. As a result, people are taking to the streets to protest rape. Recently, a tendency has been observed to take the law into one’s own hands to punish the accused in several rape cases. Even incidents of mob lynching are taking place. Even though the maximum punishment for rape is death penalty, the number of rape cases has not decreased.

However, tribunal judges have sentenced many accused to death in rape and murder cases after rape. But it takes a long time to go through the remaining two stages of the trial. Therefore, legal experts believe that initiatives should be taken to dispose of such cases quickly by forming a special bench in the Supreme Court.

Meanwhile, although there are precedents for quick disposal of some rape cases, most cases are being disposed of late in subordinate courts. Several judges of subordinate courts, who do not wish to be named, say that it is not possible to dispose of cases quickly for several reasons. One of these is the backlog of cases.
